By accessing or using the Cosmo mobile application (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, you must discontinue all access and use of the Service immediately. These terms constitute a legally binding agreement between you and Cosmo regarding your use of the Service.
2. Description of Service
Cosmo provides a mobile application for processing and editing digital images. The Service includes various features and tools for image manipulation and enhancement. Features, tools, and functionality are subject to change or removal at any time without prior notice. We do not guarantee the continuous, uninterrupted, or error-free operation of the Service, and access may be restricted, suspended, or terminated at any time for any reason.
3. Eligibility & User Responsibilities
3.1 Minimum Age
You must be at least eighteen (18) years of age to use the Service.
3.2 Account Security
You are responsible for maintaining the security of your account information. You must:
- Provide accurate information when setting up your account;
- Maintain the security of your device and any login credentials;

Cosmo is currently provided free of charge. We reserve the right to introduce paid features, subscription plans, or in-app purchases in the future. Any such changes will be communicated through the app or our website. If paid features are introduced, specific pricing and payment terms will be displayed at the point of purchase.
6. Third-Party Services
The Service may request access to your device's photo library, camera, and storage for image processing purposes. We may use third-party services to help provide, maintain, and improve the Service. Your use of such third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COSMO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, AND NON-MISAPPROPRIATION. COSMO DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU ASSUME ALL RESPONSIBILITY FOR SELECTION AND USE OF THE SERVICE, OUTPUT, OR RESULTS OBTAINED.
8. Limitation of Liability
UNDER NO CIRCUMSTANCES WILL COSMO, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, BUSINESS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY CONTENT THEREIN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT COSMO HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cosmo and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Termination
You may stop using the Service at any time by deleting your account through the app settings or uninstalling the application. We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, all licenses and rights granted to you will immediately cease, and you must stop using the Service.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. When changes are made, we will post a revised version and update the “Effective Date” above. Continued use of the Service after any changes are posted constitutes acceptance of the revised Terms. It is your responsibility to check these Terms periodically for updates.
12. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising out of or relating to these Terms or the Service shall first be addressed through good faith negotiation. If a resolution cannot be reached, disputes will be resolved in accordance with the dispute resolution mechanisms available under applicable law, which may include mediation, arbitration, or litigation in competent courts.
